When offering benefits such as paid time off (PTO) to employees, understanding the difference between PTO, vacation time, and sick time is critical to making the right policy.

Usually, the pay period includes vacation time. Vacation time refers to when an employee takes time away from work to rest, while PTO can be taken for a variety of reasons including vacation, administrative duties, maternity leave, or illness.

Employers have the right to set company rules regarding vacation time, including denying vacation days or setting rules about how employees can use vacation time. However, employees can take sick leave as needed regardless of their employer’s policy.

However, subject to any applicable law, employees may use their declared vacation days as often as they wish, even if they have exhausted their sick days and are required to use vacation time. 

Most states require employers to pay full-time employees for unused vacation days at the end of the year or when the business closes. However, most states do not have to pay sick leave to terminated employees if the employee leaves voluntarily.  

You also have the option of creating a PTO policy and a vacation policy, which combines all of a person’s days instead of separating them. Often, businesses award personal hours to their employees over time, as hours are added to their bank account during payroll. 

One American employer operates a PTO system that gives employees 10 days off (such as the Fourth of July, New Year’s Day, etc.), two vacation days, two weeks of vacation, and eight sick days per year.

If you provide equal days but do not specify the days that can be used for each period, you provide 20 days of PTO throughout the year in addition to the holidays recognized by your business.

The short answer is yes, employees get unpaid vacation time when they are on vacation. In Ontario, workers continue to receive vacation time while on protected leave, as well as continue to receive services and senior benefits while on leave. However, while employers must allow employees to take vacation time during vacations, employers are not required by law to allow employees to continue to be paid wages.
